• The Peirce Law Firm Fraud Case Continues by CSX: The Peirce fraud claim continues in W. Virginia. CSX deposed the asbestosis plaintiff who admitted not knowing certain facts about his case. This is quite normal and especially so in a mass tort claim. Nevertheless, the CSX lawyers are trying to use these facts to buttress its fraud claim. The real issue is was there fraud in the underling claim. Judge Stamp will have to examine whether the underling FELA claim was fraudulent and if there was continuing course of conduct on the part of the Peirce attorneys.
